General enquiries
If you wish to carry out work on a tree or trees, you need to check if they are protected by a Tree Preservation Order (TPO) or are within a conservation area, or if they have a planning restriction attached to them. Please contact our Customer and Democratic Support Team on 01629 816200 or customer.service@peakdistrict.gov.uk and they will advise on this and on what further is required.
It is important to note also that outside of domestic/garden settings, tree felling may require a felling licence. These are administered by the Forestry Commission - we cannot advise on or process felling licences.
Tree Preservation Order and/or Conservation Area and/or Planning Restriction in existence
- If the tree has a Tree Preservation Order (TPO) in place, you must apply for permission to undertake any works to the tree, as it is an offence to undertake work to protected trees without written permission from the Local Planning Authority. This is a form of planning application, and must be submitted either via the online Planning Portal, or using the statutory form below.
- If your tree is within a Conservation Area, you must provide this Authority with written notice six weeks before carrying out works to trees. It greatly assists our resource management if this written notice is made using either the statutory form below or the online Planning Portal – however this is not mandatory. Trees and branches which are entirely dead are exempt from the requirement, though it may be necessary to evidence this if it is subsequently queried.
- Failure to obtain consent or provide written notice can result in a court appearance and unlimited fine.
- Below is the statutory form for TPO tree work, which may also be used for trees works in a Conservation Area. Guidance notes for completing the form are also below.
Please Note: We cannot proceed until either a TPO application or a notice of Conservation Area tree works is received.
No Tree Preservation Order and not in a Conservation Area
For trees which are not protected by a TPO and are not within a Conservation Area, we would still recommend that you submit a non-statutory enquiry using the form below. Our tree conservation officers will then get in touch with appropriate advice:

Further information on the process
When you contact us you will be asked to provide your name, address and contact information, together with details of the tree, its location and any works you wish to carry out.
You will be given a reference number and on receipt of the completed form the enquiry will be passed to our Tree Conservation Officer to process.
The current turnaround for tree enquiries is approximately five weeks from receipt of completed form. We will endeavour to deal with each enquiry as quickly as possible, with dangerous trees taking priority.
