About Consultation

This consultation constitutes a notice under sections 20 and 22A(4) of the Water Industry Act 1991 (WIA91). It sets out our proposal to issue an enforcement order to South East Water Limited (South East Water) as a result of its contraventions of section 37 of the WIA91 and Condition P12 of its instrument of appointment (Licence). It also sets out our proposed decision to impose a financial penalty on South East Water. It is accompanied by the proposed enforcement order, requiring it to remedy the contraventions that we have identified.

The document summarises the evidence that we have gathered and sets out our findings in relation to the issues under investigation, including why we believe that South East Water has contravened its statutory duty and the obligations of its Licence.

Responding to this consultation

Interested parties are invited to comment on our proposed decision and the proposed enforcement order. We will take representations received into account before making a final decision on whether to issue an enforcement order and the terms of that enforcement order, as well as whether to impose a penalty and the level of that penalty.

Accordingly, any such representations or objections should be made so as to be received by Ofwat by 13 April 2026.
