Welcome to the November edition of our public advice newsletter, where you can find out more about the action we’re taking to protect the public from nuisance marketing and wider data protection issues.

United Utilities face action for failing to inform people about water quality. 

Water companies have a legal obligation to make information about the environment available. We found United Utilities repeatedly failed to respond to requests for information within the legal timeframe of 20 working days and often rejected responses by claiming the information was not environmental. 

Any information that would enlighten the public about how United Utilities operates and the impact it has on the environment is, by its very nature, likely environmental – this includes data on sewage spills and the performance of its wastewater treatment works.

We found that by using such a narrow interpretation of environmental information, United Utilities ignored the bigger picture and avoided their legal obligations to even consider whether to release the information people legitimately asked for.
 

Our message to water companies is simple – we expect transparency to be your default position. It is unacceptable to keep people in the dark when they have no choice but to rely on these firms for clean water.

ICO works to improve workers privacy rights

AI is increasingly being used in the recruitment process to save time and money, helping to source potential candidates, summarise CVs and score applicants.

But it also introduces new risks that may cause harm to jobseekers if it is not used lawfully and fairly.

We have intervened to protect workers. This month we've issued advice and guidance to both AI developers and recruiters to ensure they are respecting people’s information rights when using these tools.

We have signalled our expectations for the use of AI in recruitment, and are calling on other developers and providers to also action our recommendations as a priority. The must build trust in their tools from both recruiters and jobseekers.

ICO helps young people understand the world around them

Did you know that no matter how old you are, you can ask public authorities about a wide range of topics that affect your day-to-day life and where you live?
 

We've worked with the National Education Nature Park to help inspire a new generation and create resources that educate them on how their rights to ask for information related to the environment. 

They support teachers to run activities that get learners thinking about what environmental information is, what would help improve their understanding of their local area, and who might hold the information they need.

We've launched Our Lives, Our Privacy, a digital exhibition showcasing the 40 items that shaped 40 years of privacy rights.

It’s a diverse group of items that together tell a tale of how privacy has been at the centre of some of the biggest, most recognisable events since the Data Protection Act created the ICO in 1984.

The exhibition asks what privacy means to you. When have you valued your privacy, or felt it was at risk? Has being able to access information made a difference in your life? We’ve left space in our exhibition for you to suggest an item that means something to you personally.
